How It Works.
Trademark Searches
Before filing a trademark application, we conduct a trademark search to determine the likelihood of success in filing your application.
Preparing and Filing Trademark Application
Assuming the search results are positive or no search was conducted, the next step is preparing the trademark application and filing it with the USPTO.
Prosecution of the Application
Once the application is filed, prosecution begins and in 6-8 months a USPTO Examiner is assigned.
Publication Date/ Statement of Use
After the examiner determines the status of your mark, 3 things can happen at this point. Either a publication date will be issued, an office action will be issued or a statement of use/notice of allowance if you filed 1B.
Registration of the Trademark
If the application and prosecution is successful, the USPTO will issue an official registration along with a registration date.
Section 8 & 15 Filings
Between the fifth anniversary and the sixth anniversary of the registration, maintenance is required by filing a Section 8 declaration of continued use.

WHAT KIND OF SEARCH DO YOU PERFORM?We do a comprehensive search. However, it's not the search itself that is valuable here. What is valuable is the experience of the consultants on how to navigate the trademark registration process when your trademark registration looks unclear.

HOW LONG DOES IT TAKE? HOW WILL I KNOW MY APPLICATION HAS BEEN FILED?The registration process can take up to a year for completion. Your application will be filed the same day your payment is processed and you will receive a submission receipt from the USPTO the day the application is submitted. It takes 3 to 5 business days for it to be in the USPTO database and I will notify you of that.

SHOULD I FILE A TRADEMARK APPLICATION AS AN LLC, INDIVIDUAL, OR OTHER ENTITY?It is better to have your legal entity formed prior to filing a trademark.

DO I HAVE TO RENEW MY TRADEMARK AFTER IT'S BEEN FILED?Between the 5th and 6th year after registration, you must file a maintenance document with the USPTO to keep your trademark. Between the 9th and 10th year after registration, you must file a renewal for your trademark. Costs depend on a number of factors, including how many classes your trademark has.

SHOULD I REGISTER MY LOGO AND MY BUSINESS?The most important thing to trademark is the name in plain text if for some reason you must choose between name and logo. Registering the logo is usually done as a separate trademark application. You can save money and trademark both your logo and name by registering the logo with the name in it, but this is not recommended because if you later change your logo, you risk losing your protection for the name.
